FORMATIONLY TERMS OF USE

Effective Date: October 1, 2026

Legal Operator: Light Learning Framework LLC
Operating Brand: Formationly

Important: This document is a draft for business and legal review. It does not become binding merely because it has been prepared.

1. Welcome to Formationly

Welcome to Formationly, a Scripture-centered educational and creative platform operated by Light Learning Framework LLC ("Formationly," "we," "us," or "our").

Formationly provides biblical formation experiences, educational courses, digital storytelling, interactive learning, publications, merchandise, and related services.

These Terms of Use ("Terms") establish the conditions governing access to and use of our services.

Please read them carefully.

Our services may be accessed by adult customers, church representatives, ministry leaders, parents, teenagers, and visitors. Certain services and transactions are subject to additional requirements or separate agreements.

2. Services Covered by These Terms

These Terms apply, to the extent operated by Formationly, to:

Certain services are provided through independent third-party platforms and may also be subject to those providers' terms.

These Terms do not replace any valid, separately accepted agreement governing a specific purchase or institutional partnership.

3. Acceptance of Terms

By creating an account, purchasing a product, or expressly accepting these Terms through an applicable agreement process, you agree to be bound by them to the extent permitted by law.

Where agreement is required, Formationly will provide an appropriate opportunity to review the Terms before acceptance.

The legal effect of accessing public content without an account or express acknowledgment depends on applicable law and the circumstances of use.

Individuals who lack legal capacity to enter into binding contracts must not make purchases or enter institutional agreements independently.

Additional authorization or consent requirements may apply to minors.

If you act on behalf of a church or organization, you represent that you have authority to undertake the relevant transaction or agreement on that organization's behalf.

4. Eligibility and Age Requirements

Formationly offers different services for different audiences.

Adult purchasers and institutional representatives must have the legal capacity and authorization necessary to enter the applicable agreement.

Formationly Live's primary intended teenage audience is ages 13–18.

Teenagers may participate in the designated Formationly Live experience without creating an individual Thinkific account.

Participation may nevertheless be subject to applicable age-related requirements, church supervision arrangements, and parent or guardian permissions.

Formationly does not intend that a teenager's participation automatically creates an adult-equivalent commercial agreement.

[FINAL POLICY REQUIRED: Confirm age eligibility, under-13 access restrictions, parental permission requirements, and applicable procedures.]

5. Accounts and Registration

Certain educational products and transactions require a user account.

Account holders agree to provide accurate information and maintain reasonable security over their login credentials.

Users must not knowingly impersonate another individual, gain unauthorized access to another account, or misuse another person's credentials.

Account holders should promptly notify Formationly of suspected unauthorized access.

Formationly may take proportionate measures to protect account security.

Existing students retain their rights under applicable prior purchase agreements and previously granted entitlements.

6. Formationly's Educational Mission

Formationly provides Christian, Scripture-centered learning experiences addressing faith, identity, personal decisions, relationships, and everyday challenges.

Its content is intended for biblical education, reflection, and spiritual formation.

Different churches and Christian traditions may interpret particular theological subjects differently.

Unless expressly stated in a separate agreement, participation does not establish pastoral, counseling, medical, legal, or other licensed professional relationships.

Formationly's educational content is not a substitute for emergency assistance, mandated safeguarding procedures, or qualified professional care.

Nothing in these Terms prevents participants from reporting abuse, seeking assistance, or contacting appropriate authorities.

7. Formationly Live Participation

Formationly Live delivers structured, guided teaching sessions with character-driven stories, educational media, Scripture-centered discussion, and Teen Pulse interaction.

Participants must use the service respectfully and avoid conduct that undermines the learning environment.

Prohibited conduct includes:

Formationly may implement reasonable moderation and participation safeguards.

Reasonable intervention to address safeguarding concerns will not be treated as prohibited disruption.

8. Teen Pulse

Teen Pulse is an educational participation feature designed to support reflection and group learning.

Participants may be invited to respond to instructional questions, polls, or reflection prompts.

Teenagers should avoid including identifying details, passwords, personal contact information, or unnecessary sensitive disclosures in their responses.

Users must not attempt to infer another participant's identity from displayed group results, interfere with results, or access response information without authorization.

Formationly's intended presentation design emphasizes group-level responses and privacy-protective participation thresholds.

These Terms do not guarantee that all underlying technical information is anonymous.

Actual collection, use, retention, and sharing of participant information are addressed in the Formationly Privacy Policy.

9. Responsibilities of Participating Churches

Participating churches are expected to provide appropriate adult oversight of their youth ministry activities and comply with their applicable safeguarding responsibilities.

Depending on their partnership arrangement, churches may be responsible for:

Formationly retains the responsibilities assigned to it by law and its applicable agreements.

A church's responsibilities do not automatically release Formationly from its own legal duties.

The separate Church Partnership Agreement governs the specific division of institutional responsibilities.

10. Purchases and Payment

Formationly offers paid educational products, digital services, and merchandise.

Prices and applicable payment terms will be disclosed during the purchasing process.

Payment transactions may be processed by third-party payment service providers.

Purchasers agree to provide accurate billing information and use payment methods they are authorized to use.

Applicable taxes and any additional disclosed charges may be assessed according to the product and transaction.

A purchase is subject to successful payment processing and the terms applicable to that product.

11. Formationly Live Annual Church Partnership

Formationly's approved Annual Church Partnership offering is structured as follows:

Purchase of this offering does not establish an automatically renewing subscription.

The Thinkific enrollment course serves as the purchasing and onboarding pathway. Formationly Live teaching occurs through a separate application.

The separate Church Partnership Agreement establishes the detailed license, activation, permitted institutional use, safeguarding, and termination conditions.

If there is a conflict concerning the purchased church partnership, the applicable separately accepted Church Partnership Agreement controls to the extent permitted by law.

12. Refunds and Purchase Cancellations

Refund rights may differ between educational products, institutional partnerships, digital materials, and merchandise.

The applicable refund conditions must be clearly disclosed before purchase.

Nothing in these Terms excludes refund rights or remedies that cannot legally be waived.

Formationly will not apply an undisclosed or invented no-refunds policy.

13. Renewal and Expiration

The Formationly Live Annual Church Partnership expires according to its purchased 365-day access period.

Renewal requires a separate authorized action and payment.

Expiration does not authorize Formationly to initiate an automatic renewal charge.

Other products may have different purchase or billing terms, which must be disclosed separately.

Previously purchased access rights remain subject to the agreement that governed the original transaction.

14. Ownership of Formationly Content

Formationly and its licensors retain their respective rights in educational materials, creative works, branding, software, and other protected content.

These materials may include:

Content may include materials owned or licensed by third parties.

No ownership of third-party material is claimed merely because that material appears in a Formationly service.

15. Limited Permission to Use Content

Unless a separate agreement provides broader rights, Formationly grants authorized users a limited, nonexclusive, nontransferable permission to access purchased or publicly available content for its intended lawful use.

Users may not, without authorization or another lawful basis:

These restrictions do not prevent uses permitted by law, including applicable copyright exceptions.

Churches must consult their separate license agreements for permitted institutional use, presentations, reproduction, and distribution.

16. User Contributions and Feedback

Some Formationly experiences may allow feedback, educational responses, or other submissions.

Users must not submit content they lack the right to provide or that violates law or another person's rights.

Formationly may process submissions as reasonably necessary to provide the requested service, maintain security, or satisfy applicable legal duties, as described in its Privacy Policy.

These Terms do not grant Formationly an unrestricted right to sell, publicly commercialize, or train AI systems on teenage reflection submissions.

17. Privacy and Personal Information

Personal information practices are addressed in the separate Formationly Privacy Policy.

That policy explains, subject to its final approved wording, the collection, use, disclosure, retention, and protection of personal information.

Acceptance of these Terms does not replace any separate consent or notice required by applicable privacy law.

18. Merchandise and Online Commerce

Formationly may sell apparel, accessories, and related merchandise.

Merchandise transactions are subject to the prices, descriptions, fulfillment arrangements, and applicable policies presented with the purchase.

Products may be sold through independent marketplaces or third-party commerce services.

Where a purchase occurs through a third-party marketplace, that marketplace's transaction procedures and policies may also apply.

Formationly will disclose applicable shipping, return, and customer service information for purchases it directly administers.

Product images and representations are intended to communicate the offered goods, but material product characteristics must be accurately described.

19. Third-Party Services

Formationly uses technology and services operated by other organizations.

Depending on the relevant activity, these may include educational commerce, payment processing, hosting, video delivery, communications, and merchandise fulfillment services.

These providers may have separate terms and privacy policies.

Formationly is not automatically responsible for every independent service or website accessible through a third-party link.

This provision does not eliminate responsibilities Formationly retains under law or contract.

20. Sponsorship and Advertising

Formationly may identify approved sponsors or supporters in connection with certain content or experiences.

Any paid promotional relationship must be disclosed where legally required.

Sponsorship does not automatically grant sponsors access to Teen Pulse participant information.

Formationly will evaluate age-appropriate advertising and privacy restrictions before activating any additional advertising or tracking arrangement.

Sponsors do not receive editorial authority over Formationly's biblical instruction merely by providing financial support.

Specific sponsorship terms must be established separately.

21. Prohibited Technical and Commercial Activity

Users must not knowingly:

Nothing in these Terms prohibits lawful security reporting, protected consumer activity, legitimate criticism, or conduct protected by applicable law.

22. Service Availability and Changes

Formationly seeks to provide reliable educational experiences.

Availability may be affected by maintenance, internet connectivity, third-party service interruptions, technical failures, security incidents, or other operational circumstances.

Formationly may make reasonable changes needed to maintain security, improve functionality, or support its educational mission.

Material changes affecting paid access or promised services remain subject to the applicable purchase agreement and law.

Formationly does not guarantee uninterrupted technical availability.

23. Suspension or Termination

Formationly may restrict access where reasonably necessary to respond to:

Measures should be proportionate to the circumstances.

Notice and an opportunity to address an issue will be provided where appropriate and legally required.

Termination of a paid institutional partnership is governed by the applicable Church Partnership Agreement.

Nothing in this section authorizes forfeiture of nonwaivable rights or remedies.

24. Educational and Service Disclaimers

Formationly provides educational and faith-based content intended to support reflection, learning, and biblical formation.

Individual educational or spiritual outcomes cannot be guaranteed.

To the extent permitted by applicable law, content and services may be provided subject to reasonable limitations associated with technology and educational delivery.

Nothing in these Terms disclaims legal duties, statutory warranties, or remedies that cannot lawfully be excluded.

25. Limitation of Liability

The parties' rights and responsibilities are subject to applicable law and the agreement governing the relevant service or transaction.

Nothing in these Terms is intended to limit liability that cannot lawfully be limited, including liability for conduct for which an exclusion is prohibited.

26. Indemnification

No general indemnification obligation is imposed on teenage participants by this draft.

Church-specific allocation of responsibility should be addressed in the separate Church Partnership Agreement.

27. Disputes and Governing Law

Formationly encourages users and purchasers to contact it about concerns so that appropriate issues can be addressed promptly.

This draft does not impose mandatory arbitration, a class-action waiver, or a specific court venue.

Nothing in the final dispute resolution provisions may eliminate nonwaivable statutory rights.

28. Copyright Concerns

Formationly respects the intellectual property rights of others.

Individuals who believe content infringes their rights may contact Formationly using its designated business contact channel.

29. Changes to These Terms

Formationly may update these Terms as its services and legal obligations evolve.

Material updates will be communicated as required by applicable law.

Revised Terms will include an updated effective date.

Changes will not automatically eliminate rights arising from completed purchases or binding agreements.

Where additional acceptance is legally required, Formationly will seek it through an appropriate process.

30. Relationship to Existing Agreements

Certain customers may have purchased Bible Light Learning courses or services before the Formationly rebrand.

Their contractual rights remain governed by applicable agreements and purchase terms.

Nothing in these Terms is intended to retroactively eliminate valid lifetime access, existing enrollment rights, previously purchased benefits, or other binding commitments.

When a valid separately accepted product-specific agreement conflicts with these general Terms on that product's subject matter, the more specific agreement controls to the extent permitted by applicable law.

31. General Contract Provisions

If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law and consistent with the parties' legally enforceable agreement.

A failure to immediately enforce a provision does not necessarily waive the right to enforce it later.

No person receives a right to use Formationly trademarks, content, or services beyond the rights expressly granted or otherwise provided by law.
